        Garatia de participare- nu se constitue

        Ofertantul/ofertantul asociat, tertul sustinator si subcontractantul nu trebuie sa se regaseasca in situatiile prevazute la art.60, 164, art.165 și art.167 din Legea 98/2016 privind achizitiile publice. Probarea indeplinirii celor asumate se face prin completarea DUAE in SEAP urmand ca, la solicitarea autoritatii contractante, sa fie depuse documentele justificative aferente celor asumate prin completarea DUAE, doar de catre ofertantul clasat pe primul loc. Aceste documente sunt: • Cazierul judiciar al operatorului economic si al reprezentantului legal, asa cum rezulta din Actul constitutiv actualizat cu toate modificarile de la infiintare pana la data depunerii ofertei sau Extras din Registrul asociatiilor si fundatiilor eliberat de grefa Judecatoriei vizând pozitia referitoare la asociatie/ sau alte ocumente specifice din tara de rezidenta, in cazul operatorilor economici nerezidenti, • Cazierul judiciar al imputernicitului -daca este cazul- care apare in DUAE la cap. B „Informatii privind reprezentantii operatorului economic”. • Certificat de atestare fiscala eliberat de organul fiscal central, respectiv unitatile subordonate Agentiei Nationale de Administrare Fiscala (ANAF) pe raza căreia societatea își are sediul social, din care sa reiasă că ofertantul nu are datorii restante la momentul depunerii acestuia. Ofertantul clasat pe primul loc trebuie să prezinte certificat de atestare fiscala prin care sa ateste lipsa datoriilor restante la momentul depunerii acestuia. • Certificat privind plata impozitelor si taxelor locale din care sa reiasă că ofertanții nu au datorii restante la momentul depunerii acestuia. Ofertantul clasat pe primul loc trebuie sa prezinte certificat(e) eliberate de compartimentul/ directia de impozite si taxe locale din cadrul unitatii administrativ teritoriale pe raza căreia operatorii economici își au sediul social/puncte de lucru/sedii secundare pentru care există obligații de plata, privind plata impozitelor si taxelor locale. • Declaratie privind neincadrarea in situatiile prevazute la art. 59 si 60 din Legea 98/2016, • Declaratie privind conflictul de interese – pus la dispozitie de autoritatea contractanta, care se depune odata cu DUAE. • Pentru ofertanti nerezidenti documente echivalente emise in tara de rezidenta. In vederea completarii corecte a Declaratiei privind conflictul de interese, mai jos sunt prezentate persoanele ce detin funcții de decizie în cadrul autoritatii contractante în ceea ce priveste organizarea, derularea si finalizarea procedurii de atribuire.
