Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Bis zur Fertigstellung der Entwurfsplanung sind im Rahmen der Bodenerkundung noch Bohrarbeiten, Feld- und Laborversuche

zu verrichten. Um die Beratung und Unterstützung des Planers bzw. des Baugrundgutachters zu gewähren, ist die Teilnahme des

Gutachters an Vor-Ort-Besprechungen während der Bohrarbeiten und anderen Fachplanerbesprechungen erforderlich. Darüber

hinaus ist die Prüfungen von ermittelten Statiken und Kennwerten (Setzungsermittlungen, Abrasivitätspotential, etc.) zur

Vertragserfüllung zwingend erforderlich. Bei Bedarf unterbreitet er einen Vorschlag zur Optimierung. Im weiteren Projektverlauf

ergeben sich eine Mehrzahl von komplexen Herausforderungen, dessen Bewältigung die Erfahrung und Kompetenzen des

tunnelbautechnischen Sachverständigen erfordern.

Ein AN-Wechsel ist nicht möglich, da die Beratungsleistungen direkten Einfluss auf die Entwurfsplanung hat. Durch eine erneute

Einarbeitung in das Projekt wäre ein Wechsel des AN zudem mit erheblichen Zusatzkosten verbunden.
