Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Die zusätzlichen Oberleitungsarbeiten sind auf Grund der Nutzung der anstehenden Sperrpausen nur durch den BAU AN durchführbar. Der Aufwand zur Ausschreibung mit Vergabe oder Rahmenvertragsabruf, die erforderliche Koordinierung sowie ein An- und Abfahrt von Maschinen und Geräten einschl. BE führen zu erheblichen Schwierigkeiten auch Koordinierungsaufwand und zu erheblichen Zusatzkosten.

Der Wechsel des AN ist wirtschaftlich nicht sinnvoll, da der gebundene AN über sämtliche Planunterlagen verfügt und die Planer im Projekt tief involviert sind. Ein zweites Planungsbüro müsste sich neu einarbeiten und es entstehen neue Schnittstellen.
