Die Hamburg Port Authority AöR (HPA) benötigt für verschiedene Anwendungen (u.a. die E-Vergabeplattform oder das Dokumentenarchiv) PDF-Formulare.

Seit 2004 werden die ca. 600 Formulare mit einer Anwendung von Adobe erstellt und bearbeitet. Die bisher genutzte Software besitzt aber keinen Support mehr. Hierzu soll nun die Adobe AEM Forms Software (inkl. Support) beschafft werden, da die Software als einziges am Markt verfügbares Tool alle benötigten Funktionen enthält und eine einheitliche Lösung für alle Formulare bietet.

Die HPA plant derzeit eine Nutzung der Lizenzen für die kommenden drei Jahre.

Explanation:

Adobe hat somit die ausschließlichen Rechte zur Lieferung der Software. Der Verkauf der Lizenzen erfolgt über FORMATIX. FORMATIX ist Solution Partner von Adobe. Der direkte Bezug der Software bei Adobe ist nicht möglich, da der Vertrieb und Support ausschließlich über Solution Partner erfolgt. Wirtschaftlichere Angebote anderer Solution Partner von Adobe sind nicht möglich.

Der Auftrag soll auf Grundlage des § 13 Abs. 2 Nr. 3 b) SektVO erfolgen, da aus technischen Gründen kein Wettbewerb vorhanden ist. Es gibt keine Lösung zur Bearbeitung von PDF-Formularen auf dem Markt, die alle benötigten Funktionen enthält und eine einheitliche Lösung für alle Formulare bietet.
