Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Ein neues Vergabeverfahren führt zu Verzögerung in der Fertigstellung der Planung. Dadurch können die Bauleistungen für

die bereits angemeldeten Sperrpausen nicht mehr rechtzeitig ausgeführt werden. Das Bauvorhaben müsste dann mit zwei Jahren

Vorlauf betrieblich neu angemeldet werden. Die Baumaßnahme müsste dann um mindestens zwei Jahre verschoben werden. Die

bisherigen Abstimmungen mit DB Netz zu den Sperrpausen wären hinfällig.
