Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Aufgrund der Ablehnung des Betriebes hinsichtlich der Umsetzung des bisherigen geplanten Betriebsverfahrens, ist im Zuge von

Eskalationsrunden mit Experten zusammen festgelegt worden, dass ein anderes Betriebsverfahren für die Gleise 37-53 zu

erstellen ist. Dies führt zu Änderung in diversen LST-Planungen, bzw. in den Planungen für Geschwindigkeiten.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Aufgrund der Ablehnung des Betriebes zum bis dato geplaten Betriebsverfahrens, musste ein neues Betriebsverfahren

entwickelt und abgestimmt werden. Die Ergebnisse dieser Abstimmungen sind als Projektentscheidung protokolliert worden. Dies

führte jedoch dazu, dass Teile der Planungen angepasst werden mussten. Im Einzelnen sind es Anpassungen der

Geschwindigkteitssignalisierung in den Lage- und Übersichtsplänen und der Geschwindigkeitstabelle, sowie die Erarbeitung der

Auswirkung auf die Soll-Geschwindigkeiten.

Es handelt sich hierbei um erforderliche zusätzliche Leistungen im Zuge einer Lösungsfindung, welche parallel zur Erbringung der

Leistungen des restlichen Hauptverrtages erfolgen und somit gesamthaftlich zur Sicherstellen des Werkserfolges dienen als auch

zeitgleich zu erbringen sind.
