        Declaratia se va prezenta odata cu DUAE, de catre toti participantii la procedura de atribuire (ofertant, asociat, subcontractant si tert sustinator) .

        3. Certificat de atestare fiscala pentru persoane juridice privind obligatiile de plata la bugetul consolidat al statului in original sau copie certificata pe proprie raspundere pentru conformitate cu originalul; - cerinta minima: certificate constatatoare privind lipsa datoriilor restante cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat la momentul prezentarii. Operatorul economic va completa cerinta corespunzatoare in formularul DUAE din documentatia de atribuire. Aceste certificate de atestare trebuie prezentate in original numai de ofertantul clasat pe primul loc dupa aplicarea criteriului de atribuire, pana la data incheierii raportului procedurii de atribuire, conform art. 196 alin(2)din Legea nr. 98/2016 privind Achizitiile Publice. Operatorii economici nerezidenti (straini) au dreptul de a prezenta orice documente edificatoare, eliberate de autoritatile din tara in care acestia sunt rezidenti prin care sa dovedeasca indeplinirea obligatiilor scadente de plata a impozitelor catre bugetul de stat si bugetul local, in conformitate cu legislatia din tara de rezidenta.

        Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.

        Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de înregistrare in conditiile legii din tara de rezidenta, sa reiasa ca operatorul economic este legal constituit, ca nu se afla in niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului. Modalitatea de indeplinire: Completarea DUAE, documentul justificativ , respectiv certificatul ONRC (sau pentru ofertantii straini, document echivalent emis in tara de rezidenta), sa fie prezentate DOAR LA SOLICITAREA AUTORITATII CONTRACTANTE LA FINALIZAREA EVALUARII OFERTELOR de catre ofertantul clasat pe primul loc.
