The Department had a need to establish a call-off contractual arrangement in order to support its in-house maintenance operations. The contract is designed to provide the Department with a facility to have overspill work undertaken which occurs when in-house capacity is not sufficient to meet operational requirements. Please note that as this is a support service for

the current in-house Departmental operation, it is not guaranteed that work will be required on all vehicle manufacturer types or models throughout the duration of the Contract.

VII.2.1)Description of the modifications

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Since award DfI Roads Fleet Management and DfI Rivers Plant Unit have amalgamated into a single Fleet Unit. The contract is for overspill maintenance work to be carried out if a need arises, ordered by workshops being unable to meet workload demand internally (typically during holiday periods, adverse weather events etc.) Since amalgamation, staff vacancies continue to increase, leading to additional dependency on overspill contractors. This dependency has led to spend exceeding the initial annual estimate and will soon reach the estimated contract limit.

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

The inability to recruit appropriate staff was unforeseen and has led to an increased dependency on this contract.
