Predmet aneksa je podaljšanje pogodbenih faznih rokov R1 in R2.

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Sprememba pogodbe (podaljšanje pogodbenih faznih rokov) je dopustna na podlagi 3. točke prvega odstavka 95. člena ZJN-3, in sicer je sprememba potrebna zaradi okoliščin, ki jih skrben naročnik ni mogel predvideti (daljši čas pridobivanja projektnih pogojev s strani pristojnih mnenjedajalcev in dolgotrajna usklajevanja s pristojnimi mnenjedajalci ter prilagoditve zasnove nadvoza 4-02, zaradi zahtevnih GGH razmer). Poleg tega sprememba ne spreminja splošne narave javnega naročila, saj predmet pogodbe ostaja nespremenjen.
