        Autoritatea contractanta, va incheia acorduri-cadru pentru fiecare lot pentru 24 luni, cu max. 5 op ec, iar contractele subs vor fi încheiate și derulate de autoritățile beneficiare conform ANEXEI 2 atașată caietului de sarcini. In primele 6 luni de la intrarea in vigoare a prezentului contract, prețul este ferm, contractele subsecvente se vor încheia fără reluarea competiției, cu ofertantul clasat pe primul loc; în situația în care primul ofertant nu își susține prețul sau refuză încheierea contractului subsecvent, acesta este obligat să demonstreze imposibilitatea îndeplinirii clauzelor contractuale, autoritatea contractantă având posibilitatea încheierii contractului cu următorul clasat, până la epuizarea clasamentului. În cazul în care forta majora nu se demonstreaza, operatorul economic care nu mai sustine/refuza semnarea contractului subsecvent, suporta diferenta de pret dintre acesta si urmatorul clasat cu care se incheie contractul subsecvent. Atribuirea contractelor subsecvente ulterior primelor 6 luni de la intrarea in vigoare a acordului-cadru, se va face prin reluarea competiției, organizata la nivelul fiecarei autoritati contractante beneficiare.Obiectul reluării competiției este Prețul. Criteriul de atribuire pentru stabilirea operatorului economic căruia îi va fi atribuit contractul subsecvent este „prețul cel mai scăzut”, în baza prevederilor art. 187, alin. (3), lit. a) și alin. (3^1) din Legea nr. 98/2016 cu modificările și completările ulterioare.În cazurile prevăzute la art. 119 din Legea 98/2016, autoritatea contractantă reia competiția pe baza acelorași termeni și condiții aplicate pentru atribuirea acordului-cadru, detaliate acolo unde este necesar și completate dacă este cazul cu alți termeni și condiții prevăzute în documentația de atribuire elaborată în cadrul procedurii de atribuire a acordului-cadru, și cu respectarea următoarelor reguli procedurale:a) pentru fiecare contract subsecvent care urmează a fi atribuit (cu exceptia celor incheiate in primele 6 luni de la intrarea in vigoare a acordului-cadru) autoritatea contractantă beneficiara consultă în scris operatorii economici semnatari ai acordului-cadru respectiv;b)autoritatea contractantă beneficiară stabilește o perioadă suficientă pentru depunerea ofertelor pentru atribuirea contractului, ținând seamă de elemente specifice, precum complexitatea obiectului contractului și timpul necesar pentru transmiterea ofertelor;c)ofertele se depun în scris, iar acestea nu vor fi deschise până la expirarea perioadei stabilite de autoritatea contractantă beneficiară.d)Operatorii economici au dreptul ca în procesul de reofertare să modifice elementul/elementele care fac obiectul reluării competiţiei numai în sensul îmbunătăţirii acestuia/acestora şi fără să afecteze celelalte elementele/condiţiile stabilite.e)În cazul în care, în urma reofertării, operatorul economic clasat pe primul loc în cadrul acordului cadru nu mai menține și nici nu imbunătățește pretul ofertat autoritatea contractantă beneficiară va incheia ctr subs cu operatorul economic clasat pe locul următor care va menține sau îmbunătății prețul ofertat din acordul cadru.f)in situatia in care nu se obtine nicio imbunatatire a elementelor/conditiilor care fac obiectul reluarii competitiei sau nu se sustine pretul din acordul cadru, devin aplicabile prevederile art. 110 alin. (7) din Anexa la H.G. nr. 395/2016, autoritatea contractanta avand obligatia de a atribui ctr ofertantului clasat pe primul loc in cadrul procedurii aplicate, prin luarea in considerare a conditiilor si elementelor prevazute in oferta initiala a acestuia actualizata.In cazul in care nici dupa actualizarea pretului nu poate sustine, se poate incheia contractul cu urmatorul clasat cu oferta actualizata.
