        -doborât, sectionat, adunat,scos-apropiat în platforma primara;

        -curatirea parchetelor(daca este cazul), conform OM 1540/2011 cu modificarile si completarile ulterioare;

        -sortarea masei lemnoase în platforma primara pe tasoane;

        Autoritatea contractanta va raspunde in mod clar si complet tuturor solicitarilor de clarificare/informatiilor suplimentare in termen de zile 5 inainte de data limita de depunere a ofertelor, conform art.160 alin.(2) din Legea nr.98/2016 modificat prin OUG nr.107/2017.

        Cerinţa nr. 1. Operatorii economici participanti la procedura –ofertant ,ofertant asociat ,subcontractant ,tert sustinator - nu trebuie sa se regaseasca in situatiile prevazute la art. 164,art. 165 si art. 167 din Legea nr. 98/2016 privind achizitiile publice.

        Modalitatea de indeplinire : ,,Completare DUAE” de catre Operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor ,urmand ca la finalizarea evaluarii ofertelor autoritatea contractanta sa solicite ofertantului clasat pe primul loc urmatoarele documente justificative:

        • Certificat fiscal emis de ANAF care sa ateste lipsa datoriilor restante la momentul depunerii ;

        • Certificat taxe si impozite locale care sa ateste lipsa datoriilor restante la momentul depunerii.

        • Cazierul judiciar al operatorului economic si al membrilor organului de administrare, conducere sau de supraveghere al respectivului operator economic , sau a celor ce au putere de reprezentare, de decizie sau de control in cadrul acestuia , asa cum rezulta din certificatul constator emis de ONRC/actul constitutiv;

        • după caz, documente prin care se demonstrează faptul ca operatorul economic poate beneficia de derogările prevăzute la art. 166 alin. (2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizițiile publice;

        • Alte documente edificatoare dupa caz.

        Referitor la situatia de neincadrare in prevederile art. 60 se va completa formularul ,, DECLARAŢIE privind evitarea conflictului de interese” formular care se va prezenta odata cu DUAE ,pana la data limita de depunere a ofertelor .

        Persoanele cu functie de decizie din cadrul autoritatii contractante implicate in procedura de achizitie publica sunt : Director- Blaj Robert, Director Economic -Apolzan Adrian, Director Tehnic- Tesa Ioan Ovidiu, Comp.Financiar Contabil- Chertes Diana-Elena, Contab.         Cerinţa nr. 1.

        Operatorii economici ce depun oferta trebuie să dovedeasca o forma de inregistrare in conditiile din tara de rezidenta , sa reiasa ca operatorul economic este legal constituit , ca nu se afla in nici una din situatiile anularii constituirii precum si fapul ca are capacitatea de profesionala de a realiza activitatile care fac obiectul contractului.

        Modalitatea de indeplinire : Operatorii economici participanti la procedura de atribuire vor prezenta urmatoarele documente justificative:

        -certificat constatator eliberat de Oficiul Registrului Comertului sau in cazul ofertantilor straini , documente echivalente emise in tara de rezidenta . Datele prevazute în certificat trebuie sa fie reale/actuale la momentul prezentarii acestuia.Pentru persoanele juridice /fizice straine documente care dovedesc forma de inregistrare /atestare vor fi prezentate in traducere in limba romana .

        Cerinta nr.2.

        Ofertantul/candidatul trebuie să aibă dreptul de a presta serviciile prevăzute la Art. 62 alin. 2) din Codul Silvic, care precizează că „ Exploatarea masei lemnoase se face doar de operatori economici atestați de către comisia de atestare, care funcționează în cadrul asociației patronale și profesionale din domeniul forestier recunoscută la nivel național ”. În cazul ofertantilor straini se vor prezenta documente silmilare emise în tara de rezidenta recunoscute/echivalate de autoritatea de resort din România.

        Modalitatea de indeplinire : Operatorii economici participanti la procedura de atribuire vor prezenta urmatoarele documente justificative:

        - Atestat de exploatare tehnica eliberat de Comisia de Atestare a Operatorilor Economici în Activitatea de Exploatare Forestieră, conform prevederilor Legii 46/2008 (codul Silvic) si a prevederilor OM.1540/2011 modificat cu O.M. nr 915/2014. Ofertantul clasat pe primul loc in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor va prezenta, la solicitarea autoritatii contractante ,,Copie conforma cu originalul a atestatului de exploatare forestiera si a cazierului tehnic pentru anul in curs. Din acesta trebuie să rezulte că ofertantul/candidatul are capacitate de exploatare rămasă disponibilă conform atestatului de exploatare forestiera pentru volumul pentru care licitează. Informațiile cuprinse în acest document trebuie să fie reale/valabile la data limită de depunere a ofertelor.

      In situatia in care mai multe oferte au fost declarate admisibile de catre autoritatea contractanta si sunt clasate pe primul loc si au preturi egale autoritatea contractanta va solicita clarificari prin intermediul SEAP in vederea incarcarii electronice de catre operatorii economici de noi documente care contin noi preturi.In cazul in care din motive tehnice exclusiv legate de performantele tehnice ale SEAP nu este posibila transmiterea in format electronic prin intermediul SEAP documentele respective se transmit autoritatii contractante in plic sigilat.

      Autoritatea contractanta are dreptul de a solicita ofertantilor in circumstante exceptionale inainte de expirarea perioadei de valabilitate a ofertei prelungirea acestei perioade. In cazul extinderii de valabilitate a ofertei acesta va fi prelungita in mod corespunzator. Ofertantul are obligatia de a comunica autoritatii contractante daca este sau nu de acord cu prelungirea perioadei de valabilitate a ofertei .Ofertantul care nu este de acord cu prelungirea perioadei de valabilitate a ofertei se considera ca si-a retras oferta fara ca acest fapt sa atraga pierderea garantiei de participare.

      Ofertantul va prezenta o declaratie prin care accepta clauzele contractuale cuprinse in modelul de contract din documentatia de atribuire .In situatia in care sunt obiectiuni la proiectul de contract respectiv modificari ale clauzelor contractuale sau adaugarea unor clauze noi eventualele propuneri de modificare/completare/eliminare de clause contractual vor fi formulate in scris cu justificari si inaintate cu oferta . Daca propunerile sunt dezavantajoase pentru autoritatea contractanta aceasta isi rezerva dreptul de a le respinge informand ofertantul. Daca ofertantul nu renunta la aceste clauze autoritatea contractanta va incadra oferta ca neconforma si o va respinge.

      In situatia incare ofertantul apeleaza la o asociere cu alti operatori,la terti sustinatori sau la subcontractanti ,in afara documentelor solicitate expres la Cap. III.2-conditii de participare, in cuprinsul ofertei vor fi incluse si Angajament(e)+declaratii tert sustinator /acord asociere/declaratie privind partile din contract care se subcontracteaza ,dupa caz ,intocmite in conformitate.

      ”Cerintele tehnice definite la nivelul anuntului de participare, caietului de sarcini sau altor documente complementare, prin trimiterea standardelor, la un anumit producator, la marci, brevete, tipuri, la o origine sau la o productie/metoda specifica de fabricatie/prestare/executie, vor fi intelese ca fiind insotite de mentiunea ”sau echivalent”.
