                                  (3) În cazul în care două sau mai multe oferte sunt clasate pe primul loc, cu punctaje egale, departajarea se va face având în vedere

                                  punctajul obținut la factorii de evaluare în ordinea descrescătoare a ponderilor acestora.

                                  În situația în care egalitatea se menține, autoritatea contractantă are dreptul să solicite noi propuneri financiare, și oferta câștigătoare va fi

                                  desemnată cea cu propunerea financiară cea mai mică.

                                  Confidentialitatea: Fără a aduce atingere celorlalte prevederi ale prezentei legi sau dispozițiilor legale privind liberal acces la informațiile de interes public ori ale altor acte normative care reglementează activitatea autorității contractante, autoritatea contractantă are obligația de a nu dezvălui informațiile din propunerea tehnică, elementele din propunerea financiară și/sau fundamentări/justificări de preț/cost transmise de operatorii economici indicate și dovedite de aceștia ca fiind confidențiale întrucât sunt: date cu caracter personal, secrete tehnice sau comerciale sau sunt protejate de un drept de proprietate intelectuală.
