        Servicii de exploatare a masei lemnoase, produse principale, accidentale si secundare din fond forestier administrat prin ocoalele Direcției silvice Arad. Fiecare partidă constituie un lot în cadrul achiziției. Fazele serviciilor prestate vor include doborârea, curățarea de crăci și secționatul arborilor în parchet, adunatul, scos-apropiatul până în platforma primară și fasonarea sortimentelor în platforma primară, în condițiile cerințelor din caietul de sarcini. Operatorii economici vor putea solicita clarificări cu 18 zile înainte de termenul stabilit pentru depunerea ofertelor, autoritatea contractantă răspunzând în mod clar și complet tuturor solicitărilor de clarificare/ informațiilor suplimentare în a 11 a zi înaintea termenului limită de depunere a ofertelor.

        List and brief description of conditions:

        Declaratie privind neincadrarea in prevederile art. 164, art. 165 si art. 167 din Legea nr. 98/2016 privind achizitiile publice. Modalitate de indeplinire: se va completa DUAE. Precizari: Formularul DUAE este pus la dispozitia ofertantilor in platforma SEAP, unde a fost configurat de autoritatea contractanta. Raspunsul ofertantilor se va face accesand formularul dupa autentificare in SEAP. a) Incadrarea in una sau mai multe dintre situatiile prevazute la art. 164, art. 165 si art. 167 din Legea nr. 98/2016 privind achizitiile publice, atrage excluderea ofertantului din procedura pentru atribuirea contractului; b) Ofertantul clasat pe primul loc in clasamentul intocmit la finalizarea evaluarii ofertelor va prezenta, la solicitarea autoritatii contractante, documentele justificative care probeaza indeplinirea cerintelor asumate, dupa cum urmeaza: - certificate constatatoare privind lipsa datoriilor restante, VALABILE LA MOMENTUL PREZENTĂRII ACESTORA, cu privire la plata impozitelor, taxelor si a contributiilor de asigurari sociale la bugetul de stat si la bugetul local (pentru sediul social, sediile secundare, precum si punctul/punctele de lucru pentru care exista obligatii de plata), Cazierul judiciar pentru operatorul economic și Cazierul judiciar pentru fiecare din membrii organului de administrare, de conducere sau de supraveghere al operatorului economic și pentru persoanele care au putere de reprezentare, de decizie sau de control în cadrul acestuia sau alte documente echivalente. - În cazul in care in tara de origine sau in tara in care este stabilit operatorul economic, nu se emit documente de tipul celor solicitate sau acestea nu vizeaza toate situatiile cuprinse la art. 164, art. 165 si art. 167, se accepta orice document considerat edificator emis de autoritati competente din tara respectiva; - in cazul ofertantilor persoane juridice/fizice straine documentele vor fi transmise in limba in care au fost emise, insotite de o traducere autorizata a acestora in limba romana. In sensul prevederilor art. 63 alin. (1) din Legea nr. 98/2016 privind achizitiile publice, persoane cu functie de decizie din cadrul DS Arad: Teodor Țigan, Pascalau Mircea, Zorlintan Paula, Grajdanescu Adrian, Zdrenghea Gelu, Aldea Adina, Cristea Nicoleta.

        Cerinta nr.1. Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, sa reiasa ca operatorul economic este legal constituit, ca nu se afla in niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului. Modalitatea de deplinire a cerintei: “Completare DUAE” de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor, urmand ca la finalizarea evaluarii ofertelor autoritatea contractanta sa solicite ofertantului clasat pe primul loc urmatoarele documente justificative: - Certificat constatator eliberat de Oficiul Registrului Comertului, sau in cazul ofertantilor straini, documente echivalente emise in tara de rezidenta. Informatiile cuprinse in documentele justificative trebuie sa fie reale/valide la data prezentarii acestora. Pentru persoane juridice/fizice straine documentele care dovedesc o forma de inregistrare / atestare vor fi prezentate in traducere in limba romana.

        Cerinta nr.2 Ofertantul trebuie sa faca dovada ca este atestat pentru activitatea de exploatari forestiere conform prevederilor art. 2 Regulamentul anexă la O.M. 1330/2015 . Modalitatea de indeplinire a cerintei: “Completare DUAE” de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor, urmand ca la finalizarea evaluarii ofertelor autoritatea contractanta sa solicite ofertantului clasat pe primul loc urmatoarele documente justificative: Certificat de atestare eliberat conform ordinului O.M. 1330/2015 si Cazier tehnic completat la zi cu cota de masă lemnoasă exploatată. Persoane juridice/fizice straine vor depune documente similare care sa dovedeasca atestarea pentru exploatare forestiera, prezentate in traducere in limba romana.
