Precise information on deadline(s) for review procedures:

Entsprechend der Regelungen in § 160 GWB:

1) Die Vergabekammer leitet ein Nachprüfungsverfahren nur auf Antrag ein;

2) Antragsbefugt ist jedes Unternehmen, das ein Interesse an dem öffentlichen Auftrag oder derKonzessionhatund eine Verletzung in seinen Rechten nach § 97 Absatz 6 durch Nichtbeachtung vonVergabevorschriftengeltend macht. Dabei ist darzulegen, dass dem Unternehmen durch die behaupteteVerletzung der Vergabevorschriften ein Schaden entstanden ist oder zu entstehen droht;

3) Der Antrag ist unzulässig, soweit:

a) Der Antragsteller den geltend gemachten Verstoß gegen Vergabevorschriften vor Einreichen desNachprüfungsantrags erkannt und gegenüber dem Auftraggeber nicht innerhalb einer Frist von 10Kalendertagen gerügt hat; der Ablauf der Frist nach § 134 Absatz 2 bleibt unberührt;

b) Verstöße gegen Vergabevorschriften, die aufgrund der Bekanntmachung erkennbar sind, nicht spätestens biszum Ablauf der in der Bekanntmachung benannten Frist zur Bewerbung oder zur Angebotsabgabe gegenüberdem Auftraggeber gerügt werden;

c) Verstöße gegen Vergabevorschriften, die erst in den Vergabeunterlagen erkennbar sind, nicht spätestens biszum Ablauf der Frist zur Bewerbung oder zur Angebotsabgabe gegenüber dem Auftraggeber gerügt werden;

d) Mehr als 15 Kalendertage nach Eingang der Mitteilung des Auftraggebers, einer Rüge nicht abhelfen zuwollen, vergangen sind.

Satz 1 gilt nicht bei einem Antrag auf Feststellung der Unwirksamkeit des Vertrags nach § 135 Absatz 1Nummer 2. § 134 Absatz 1 Satz 2 bleibt unberührt.

Verlängerung des bestehenden Vertrages um 3 Monate, keine Änderungen in der Ausführung

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Aufgrund einer ungeplanten langen Abwesenheitszeit im Recruiting-Team, wurden die noch vorhandenen personellen Ressoursen für die Aufrechterhaltung des Tagesgeschäfts gebündelt, so dass eine Bearbeitung der Neuausschreibung nicht wie geplant erfolgen konnte bzw. sich zeitlich verzögert. Weiterhin ist anzumerken, dass im Rahmen der RIFS Integration ab 01.01.2023 neue, nicht im Rahmen der Integrationsvorbereitung vorhersehbare Anforderungen für das Recruiting hinzugekommen sind, die erst noch einer gründlichen Erarbeitung und Abstimmung bedürfen. Zudem sollen die Ergebnisse aus einer Leitungsklausur (durchgeführt im Juni 2023) u.a. zum Thema Fachkräftegewinnung gebündelt werden und in die Ausgestaltung der Neuausschreibung einfließen.
