In conformitate cu prevederile art. 160 din Legea nr. 98/2016, termenul limita pana la care orice operator economic interesat are dreptul de a solicita clarificari sau informatii suplimentare in legatura cu documentatia de atribuire este de 20 zile inainte de data limita de depunere a ofertelor.

        B. In conformitate cu prevederile art. 161 alin.         Informatii si formalitati necesare pentru evaluarea respectarii cerintelor mentionate:

        Cerința 1: Ofertanții/asociații/terții susținători/subcontractanții nu trebuie să se regăsească în situațiile prevazute la art. 164, 165, 167 din Legea nr.98/2016.

        Modalitatea prin care poate fi demonstrată îndeplinirea cerinței:

        a) Ofertanții vor completa, cu informațiile aferente situației lor, fișierul DUAE publicat de autoritatea contractantă în cadrul documentației de atribuire direct în SEAP;

        b) Documentele justificative, care vor proba îndeplinirea celor asumate prin completarea DUAE, vor fi prezentate, la solicitarea autorității contractante, doar de către ofertanții clasați pe primele 3 locuri.

Certificate constatatoare privind plata impozitelor, taxelor sau a contribuțiilor la bugetul general consolidat (buget local, buget de stat etc.) valabile la momentul prezentării pentru sediul principal, iar pentru sediile secundare/punctele de lucru o declarație pe propria răspundere privind îndeplinirea obligațiilor de plată a impozitelor, taxelor sau contribuțiilor la bugetul general consolidat datorate - scanate în format .pdf și semnat electronic.

        2. Cazierul judiciar al operatorului economic și al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau al celor ce au putere de reprezentare, de decizie sau de control în cadrul acestuia, așa cum rezultă din certificatul constatator emis de ONRC/actul constitutiv – actualizate/la zi în momentul prezentării - scanat în format .pdf și semnat electronic.

        Notă: În cazul ofertanților străini se vor prezenta documente echivalente eliberate de autorități competente din țara de reședință - scanate în format .pdf și semnate electronic.

        Cerința 2: Ofertanții/asociații/terții susținători/subcontractanții nu trebuie sa se regăsească în situațiile prevazute la art. 60 din Legea 98/2016. Persoanele cu funcție de decizie din cadrul autorității contractante:

        Modalitatea prin care poate fi demonstrată îndeplinirea cerinței:

        b) Documentele justificative care vor proba îndeplinirea celor asumate prin completarea DUAE vor fi prezentate, la solicitarea autorității contractante, doar de către ofertanții clasați pe primele 3 locuri.

        Aceste documente sunt:

        1. Declarație conform art. 60 din Legea 98/2016 - scanată în format .pdf și semnată electronic.

        Cerința 1: Operatorul economic ce depune ofertă trebuie să dovedească o forma de înregistrare în condițiile legii din țara de rezidență, că este legal constituit și nu se află în niciuna dintre situațiile de anulare a constituirii, precum și faptul că are capacitatea profesională de a realiza activitățile care fac obiectul contractului

        Modalitatea prin care poate fi demonstrată îndeplinirea cerinței:

        2. Certificatul constatator emis de Oficiul Național al Registrului Comerțului - valabile în momentul prezentării - scanat în format .pdf și semnat electronic.
