  3. Section III
    1. Conditions for participation:
      1. Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers:
        List and brief description of conditions:

        Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca în situatiile prevazute la art.164, 165, 167 din Legea nr.98/2016; Modalitatea prin care poate fi demonstrata îndeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor,. Documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I în clasamentul intermediar întocmit la finalizarea evaluarii ofertelor. Documentele justificative pot fi :1.•certificate constatatoare privind lipsa datoriilor restante cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat etc.) la momentul prezentarii; 2.• cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control în cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC / actul constitutiv; 3.• dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. (2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizitiile publice; 4.• alte documente edificatoare, dupa caz.

        Persoanele juridice / fizice straine, în calitate de ofertanti, sau parteneri ai unei asocieri, vor prezenta documente echivalente, emise in conformitate cu legislatia aplicabila in tara de rezidenta, în original sau copie certificata “conform cu originalul” însotite de o traducere autorizata a acestora în limba româna.

        Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca în situatiile prevazute la art. 60 din Legea nr.98/2016. Declaratia pe propria raspundere privind neîncadrarea în prevederile art. 60 din Legea nr.98/2016 privind achizitiile publice va fi completata de toti participantii odata cu depunerea DUAE . Persoanele cu functie de decizie din cadrul autoritatii contractante, in ceea ce priveste organizarea, derularea si finalizarea proceduriide atribuire sunt:

        Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de înregistrare în conditiile legii din tara de rezidenta, sa reiasa ca operatorul economic este legal constituit, ca nu se afla în niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului. Modalitate prin care poate fi demonstrata îndeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE, respectiv certificat constatator emis de ONRC, sau în cazul ofertantilor straini, documente echivalente emise în tara de rezidenta, urmeaza sa fie prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I în clasamentul intermediar întocmit la finalizarea evaluarii ofertelor.

        Persoanele juridice / fizice straine, în calitate de ofertanti, sau parteneri ai unei asocieri, vor prezenta documente echivalente, emise in conformitate cu legislatia aplicabila in tara de rezidenta, în original sau copie certificata “conform cu originalul” însotite de o traducere autorizata a acestora în limba româna.

        Operatorii economici ce depun oferta trebuie sa dovedeasca ca detin Avizul/Autorizatia de functionare eliberata de Ministerul Sanatatii si/sau Autorizatia pentru activitatea de distributie angro de medicamente,valabile la momentul prezentarii, pentru distribuitor, conform ordinului MSP 131/04.02.2016, art. 2 si art. 3 pt. aprobarea normelor privind autorizarea unitatilor de distributie angro de medicamente de uz uman, certificarea de buna practica de distributie si înregistrarea brokerilor de medicamente de uz uman. In cazul persoanelor fizice autorizate se va prezenta autorizatia de functionare sau alte documente echivalente din care sa rezulte competenta acestora de a livra produsele care fac obiectul prezentului contract; Operatorii economici nerezidenti (straini): vor prezenta documente care dovedesc o forma de înregistrare/ atestare ori apartenenta din punct de vedere profesional, din care sa rezulte abilitarea persoanei juridice/fizice straine de a livra produsele care fac obiectul prezentului acordului cadru, în conformitate cu tara de origine/tara în care operatorul economic este stabilit.

        Modalitate prin care poate fi demonstrata îndeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE, urmeaza sa fie prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I în clasamentul intermediar întocmit la finalizarea evaluarii ofertelor.

        Operatorii economici ce depun oferta vor dovedi ca produsul/ produsele ofertate detin autorizatia de punere pe piata emisa de AgentiaNationala a Medicamentului si Dispozitivelor Medicale (ANMDM), în termen de valabilitate la momentul prezentarii (sau dovada ca se afla în curs de reautorizare). Actul normativ care impune obligativitatea acestei autorizari - Legea 95/2006 - republicata privind reforma in domeniul sanatatii (art.704 alin.1 si alin 2 - Titlul XVIII Medicamentul). Persoanele juridice / fizice straine, în calitate de ofertanti, sau parteneri ai unei asocieri, vor prezenta documente similare cu cele solicitate, valabile în tara de origine, în original sau copie certificata “conform cu originalul” însotite de o traducere autorizata a acestora în limba româna.

        Completarea DUAE. Documentele justificative care probeaza indeplinirea celor asumate prin completarea formularului DUAE si anume – copii contracte/certificate de predare-primire/procese verbale/recomandari/certificate constatatoare/alte documente din care sa rezulte ca au fost furnizate produse similare obiectului procedurii de achizitie, urmeaza a fi prezentate doar la solicitarea autoritatii contractante si doar de catre ofertantul clasat pe primul loc la finalizarea evaluarii ofertelor.Capacitatea tehnica si/sau profesionala a operatorului economic poate fi sustinuta în conformitate cu art.182 din Legea nr.98/2016. Modalitate de indeplinire: completare DUAE. Odata cu depunerea DUAE ofertantul va prezenta angajamentul tert sustinatorului impreuna cu documente anexa la angajament, transmise acestora de catre tert/tertii sustinaori, din care rezulta modul efectiv in care se va materializa sustinerea acestuia/acestora) urmand ca documentele justificative care probeaza cele asumate in angajamente sa fie solicitate de catre autoritatea contreactanta doar ofertantului clasat pe locul I in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.

        Completarea DUAE. Ofertantii vor prezenta acordul de subcontractare odata cu oferta si DUAE pana la data limita a depunerii ofertelor. Documentele justificative care probeaza cele asumate in acordul de subcontractare vor fi solicitate doar ofertantului declarat castigator la solicitarea autoritatii contractante.
