                            Informatii despre tertul/tertii sustinatori 1.1 Operatorul economic are dreptul sa invoce sustinerea unui/unor tert/terti in ceea ce priveste indeplinirea criteriilor referitoare la capacitatea tehnica si profesionala, indiferent de natura relatiilor juridice existente intre operatorul economic si tertul/tertii respectiv/respectivi. 1.2 Se va prezenta de catre toti ofertantii o data cu depunerea DUAE daca este cazul si angajamentul tertului sustinator (impreuna cu documente anexe la angajament, transmise acestora de catre tert/tertii sustinatori, din care rezulta modul efectiv in care se va materializa sustinerea acestuia/acestora), acordul de asociere si acordul de subcontractare. 2. Informatii despre asociere 2.1 Orice operator economic are dreptul de a participa la procedura de atribuire în calitate de ofertant sau candidat, individual ori în comun cu alti operatori economici, inclusiv în forme de asociere temporara constituite în scopul participarii la procedura de atribuire, subcontractant propus sau tert sustinator, în conditiile prevazute de prezenta Legea 98/2016. 2.2 Ofertantul va depune acordul de asociere odata cu DUAE. Nedepunerea acestuia odata cu DUAE, constituie temei pentru solicitarea de clarificari pentru eventualele inadvertente de forma ale informatiilor cuprinse in sectiunile DUAE, atât ale ofertantului/candidatului, cât si ale subcontractantului/tertului sustinator, acest lucru fiind necesar pentru a asigura desfasurarea corespunzatoare a procedurii de atribuire. 2.3 Fiecare asociat va prezenta propriul DUAE, semnat cu semnatura electronica extinsa a asociatului. În cazul în care două sau mai multe oferte sunt clasate pe primul loc, cu punctaje egale, autoritatea contractantă are dreptul să solicite noi propuneri financiare, şi oferta câştigătoare va fi desemnată cea cu propunerea financiară cea mai mică. Nota 1: Inainte de atribuirea contractului, autoritatea contractanta solicita ofertantului clasat pe primul loc dupa aplicarea criteriului de atribuire sa prezinte documente justificative actualizate prin care sa demonstreze indeplinirea tuturor criteriilor de calificare, in conformitate cu informaţiile declarate in DUAE. Nota 2: In situatia in care ofertantul clasat pe primul loc nu demonstreaza in mod corespunzator indeplinirea integrala a tuturor criteriilor de calificare, autoritatea contractanta solicita ofertantului clasat pe locul urmator sa depuna toate documentele justificative ca dovada a informatiilor cuprinse in DUAE, in scopul verificarii indeplinirii criteriilor de calificare. Autoritatea contractanta atribuie contractul ofertantului clasat pe locul urmator, daca acesta indeplineste toate criteriile de calificare prevazute in Anuntul de participare si/sau in Instructiunile catre ofertanti. Cerintele tehnice definite la nivelul anuntului de participare, caietului de sarcini sau altor documente complementare, prin trimiterea standardelor, la un anumit producator, la marci, brevete, tipuri, la o origine sau la o productie/metoda specifica de fabricatie/prestare/executie, vor fi intelese ca fiind insotite de mentiunea ”sau echivalent
