VII.2)Information about modifications
VII.2.1)Description of the modifications
Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Por via da presente adenda é alterado o Gestor de Contrato, descrito na Cláusula 81ª do antedito contrato passando a assumir tais funções, nos termos do artigo 290.º - A do Código dos Contratos Públicos.

Por via da presente adenda são, ainda, alteradas as durações referentes às fases do presente contrato, nos seguintes termos:

1. A presente cláusula revoga a cláusula n.º 9 anteriormente prevista. Devendo assim as partes outorgantes considerar o conteúdo ora disposto devidamente aprovado nos termos e para os efeitos legalmente impostos, a produzir efeitos com a sua aprovação.

2. Assim, o presente contrato passará a ter as seguintes fases, nos termos estabelecidos no CAPÍTULO VII:

a. Período de Transição Inicial: inicia-se a data de Produção de Efeitos no dia 2 de fevereiro de 2023, até ao dia anterior ao início do Período de Exploração, conforme definido na alínea seguinte.

b. Período de Exploração: inicia-se após o términus do período de transição inicial, ou seja, no dia 1 de agosto de 2024, com duração de cinco anos.

c. Período de Transição Final: inicia-se desde o dia seguinte ao termo do Período de Exploração, por um período máximo de 9 meses, mediante a data a definir pelo Concedente.

3. A Concessionária deve notificar o Concedente da data de início do Período de Exploração no prazo de 1 (um) mês após a Data de Produção de Efeitos.

4. Para efeitos do disposto no número anterior, deverá a Concessionária notificar a CIMTS do adiamento do início do Período de Exploração no prazo de 2 (dois) meses após a Data de Produção de Efeitos.

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Alteração anormal e imprevisível das circunstâncias (Art. 312.º, al. b) do CCP com redação da Lei n.º 30/2021, de 21.05).
