Sexta modificação objetiva ao contrato n.º 4500025162/2020, em resultado de uma alteração ao projeto de execução proposta pelo empreiteiro, ao abrigo do disposto na Cláusula Geral 23.ª do Caderno de Encargos.

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Alteração ao projeto de execução, ao abrigo do disposto na Cláusula Geral 23.ª do Caderno de Encargos. As alterações propostas pelo empreiteiro não geram decréscimo da utilidade, duração e solidez da obra, promovendo, pelo contrário, uma maior rapidez de execução, redução dos riscos associados ao desmonte do quebra-mar submerso com recurso a explosivos, redução do risco de instabilização da cabeça do quebra-mar existente e uma economia de, aproximadamente, € 2.678.257,72 relativamente ao valor inicial do contrato. Por força do disposto no n.º 4 da sobredita Cláusula do Caderno de Encargos, “se da alteração aprovada resultar economia, sem decréscimo da utilidade, duração e solidez da obra”, o empreiteiro terá direito a metade do valor da respetiva redução.
