                                              1. Zgodnie z art. 139 ust. 1 Zamawiający może najpierw dokonać badania i oceny ofert, a następnie dokonać kwalifikacji podmiotowej Wykonawcy, którego oferta została najwyżej oceniona, w zakresie braku podstaw wykluczenia oraz spełniania warunków udziału w postępowaniu.

                                              2. Wykonawca w celu wykazania braku podstaw do wykluczenia w zakresie wskazanym w rozdziale X SWZ składa Jednolity Europejski Dokument Zamówienia w zakresie obejmującym określone przez Zamawiającego kryteria kwalifikacji oraz podstawy wykluczenia z postępowania. Informacje zawarte w JEDZ stanowią dowód tymczasowo zastępujący wymagane przez zamawiającego podmiotowe środki dowodowe, wskazane w rozdziale XII SWZ. Wykonawca może ograniczyć się do wypełnienia sekcji α w części IV JEDZ i nie musi wypełniać żadnej z pozostałych sekcji w części IV.

                                              W zakresie przesłanki wykluczenia, o której mowa w Rozdziale X ust. 2 pkt 1) SWZ, Wykonawca składa oświadczenie w Części III Sekcja D jednolitego dokumentu „Podstawy wykluczenia o charakterze wyłącznie krajowym”.

                                              3. O udzielenie zamówienia mogą ubiegać się Wykonawcy, którzy spełniają warunki udziału w postępowaniu oraz nie podlegają wykluczeniu z postępowania w okolicznościach wskazanych w ustawie Prawo zamówień publicznych. W celu potwierdzenia spełnienia warunków udziału w postępowaniu oraz braku podstaw wykluczenia wykonawcy z udziału w postępowaniu oraz potwierdzenia, że oferowane dostawy odpowiadają wymaganiom określonym przez zamawiającego, zamawiający żąda dokumentów określonych w Rozdziale XII i XIV SWZ. Wykonawca składa ofertę w sposób określony w Rozdziale XV SWZ. Dodatkowo Wykonawca zobowiązany jest do złożenia wraz z ofertą dokumentów określonych w Rozdziale XIII SWZ.

                                                Dokładne informacje na temat terminów składania odwołań:

                                                1. Wykonawcom oraz innym podmiotom, którzy mają lub mieli interes w uzyskaniu zamówienia oraz ponieśli lub mogą ponieść szkodę w wyniku naruszenia przez zamawiającego przepisów ustawy, przysługują środki ochrony prawnej przewidziane w dziale IX ustawy PZP: środki ochrony prawnej.

                                                2. Odwołanie przysługuje na: niezgodną przepisami ustawy czynność zamawiającego, podjętą w postępowaniu o udzielenie zamówienia, w tym projektowanie postanowienia umowy; zaniechanie czynności w postępowaniu o udzielenie zamówienia, do której zamawiający był obowiązany na podstawie ustawy; zaniechanie przeprowadzenia postępowania o udzielenie zamówienia, mimo że zamawiający był do tego obowiązany.

                                                3. Odwołanie powinno wskazywać czynności lub zaniechanie czynności zamawiającego, której zarzuca się niezgodność z przepisami ustawy, zawierać zwięzłe przedstawienie zarzutów, określać żądanie oraz wskazywać okoliczności faktyczne i prawne uzasadniające wniesienie odwołania.

                                                4. Odwołanie wnosi się do Prezesa Izby.

                                                5. Odwołujący przekazuje zamawiającemu odwołanie w formie elektronicznej albo w postacie elektronicznej albo kopię tego odwołania, jeżeli zostało wniesione w formie pisemnej, przed upływem terminu do wniesienia odwołania w taki sposób, aby mógł on zapoznać się z jego treścią przed upływem tego terminu.

                                                6. Na orzeczenie Izby oraz postanowienie Prezesa Izby, o którym mowa w art. 519 ust. 1 ustawy Pzp, stronom oraz uczestnikom postępowania odwoławczego przysługuje skarga do sądu.
