         Warunek zostanie spełniony jeżeli Wykonawca posiada aktualne zezwolenie na obrót produktami leczniczymi zgodnie z ustawą z dnia 6 września 2001 roku Prawo farmaceutyczne (t.j. Dz. U. z 2022 r. poz. 2301 ze zm.) tj. zezwolenie Głównego Inspektora Farmaceutycznego na prowadzenie hurtowni farmaceutycznej, składu konsygnacyjnego lub kserokopię złożonego do rejestracji wykazu wytwarzanych produktów leczniczych lub zezwolenie na prowadzenie działalności gospodarczej w zakresie wytwarzania środków farmaceutycznych lub oświadczenie, że dla oferowanego przez Wykonawcę przedmiotu zamówienia takie zezwolenie nie jest wymagane.

         1. Zamawiający wymaga od Wykonawcy, aby zawarł z nim umowę w sprawie zamówienia publicznego w formie pisemnej, na warunkach określonych we wzorze umowy zawartym w załączniku nr 5 do SWZ. 2.
