IV.1.1)Type of procedure

The works, supplies or services can be provided only by a particular economic operator for the following reason:
- absence of competition for technical reasons

Explanation:

Gemeente Losser wil gebruik maken van de in artikel 2.32 lid 1 onderdeel b onder 2 geboden mogelijkheid van vrijstelling van de aanbestedingsplicht op grond van mededinging om technische redenen. De onderzochte substituten voldoen niet aan onze duurzaamheidsdoelstelling óf niet aan de bedrijfszekerheid voor calamiteiten en winterdienst, welke gevraagd is in de bedrijfsvoering van gemeente Losser.

Door de gevraagde inzet van het voertuig, o.a. in de winterdienst en in de calamiteitendienst, voorzien Batterij Elektrische voertuigen niet in de inzetgarantie welke een conventioneel (HVO100) voertuig voorziet. Door inzet van een Plug-In Hybride voertuig wordt wel elektrisch gewerkt en gereden, maar kunnen de voertuigen, door het gebruik van HVO100, ook in de calamiteitendienst ingezet worden.

Daarnaast wordt er met een Plug-In Hybride voertuig elektrisch (ondersteund) gereden, wat een brandstofbesparing oplevert, en kan de autolaadkraan elektrisch worden gebruikt. Hiermee wordt zowel brandstof bespaard als de CO2 uitstoot teruggedrongen.

Gemeente Losser is voornemens om de overeenkomst op korte termijn en zonder voorafgaande Europese aanbestedingsprocedure te sluiten en plaatst daarom deze vrijwillige aankondiging uit transparantie en rechtszekerheid.

Belanghebbenden die van oordeel zijn dat gemeente Losser in

strijd handelt met het aanbestedingsrecht, hebben de mogelijkheid om binnen 21 kalenderdagen – na publicatie van

deze vrijwillige aankondiging – een kort geding aanhangig te maken op straffe van verval van recht.

Indien niet binnen 21 dagen na publicatie van deze vrijwillige aankondiging een kort geding aanhangig is gemaakt en de vernietiging van de overeenkomst niet is ingeroepen, zal gemeente Losser tot definitieve gunning van de opdracht overgaan.
