    1. Conditions for participation:
      1. Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers:
        List and brief description of conditions:

        In order to prove its personal condition, the economic operator is obliged to submit the following documents:

        - Statement of the economic operator that in the past five years it was not rendered a final judgment for participation in criminal organization, corruption, fraud or money laundering, pursuant to Article 88, paragraph 1 of PPL

        - Confirmation by a competent organ that a bankruptcy procedure was not opened

        - Confirmation by a competent organ that a liquidation procedure was not opened

        - Confirmation for paid taxes, contributions and other public duties by a competent organ in the country where the economic operator was registered

        - Certificate from the Registry of penalties for crimes committed by legal persons that minor penalty ban on participation in public tender procedures, awarding contracts and agreements for public-private partnership has not been imposed on him.

        - certificate from the Registry of penalties for crimes committed by legal persons that a minor penalty for temporary or permanent prohibition of a specific activity has not been imposed over him;

        - confirmation that a final judgment - prohibition of professional activity or duty, i.e. temporary prohibition for performing professional activity has not been imposed on him.

        Capacity for performing professional activity of economic operator:

        -Document for registered activity: As a condition for meeting the conditions for its professional capacity, the economic operator shall submit: Document for registered activity (DRD Form ) as an evidence that it is registered as natural or legal entity for performing the activity related to the public procurement contract subject or an evidence that is a member of a relevant professional association in accordance to the regulation of the country where it is registered. In the Republic of North Macedonia, a competent organ for issuing this document is the Central Registry of the Republic of North Macedonia. When determining their capacity for performing professional activity, the contracting organ for Part 1 of the procedure (Procurement of burning oil – Extra light 1 (EL-1) shall also require evidence issued by a competent authority for meeting the special conditions for performing the activity prescribed by law relating to the public procurement subject. When determining the capacity for performing professional activity, for Part 2 of the procedure (Procurement of petroleum and diesel fuel) the contracting organ shall not request evidence issued by a competent authority for meeting the special conditions for performing the activity prescribed by law relating to the public procurement subject. The economic operator shall prove the meeting of the special conditions for performing the activity prescribed by law relating to the public procurement subject for Part 1 (Procurement of burning oil – Extra light 1 (EL-1)) by submitting a valid license for performing energy activity trade with crude oil, oil derivatives, bio fuels and transport-wholesale fuels issued by the Energy Regulatory Commission of R.N.Macedonia.

        List and brief description of selection criteria:

        In order to qualify as capable for performing the subject public procurement contract for Part 1: 1. The economic operator in the last 3 (three) years (2020, 2021 and 2022) to have quality and successfully realized minimum 5 (five) oil derivatives delivery contracts. The economic operator shall prove the meeting of those minimal conditions for Part 1 of the procedure (Procurement of burning oil – Extra light 1 (EL-1) by submission of the following: 1. List of successfully realized contracts related to the public procurement contracts in the last three years (2020,2021 and 2022), with contract values, dates of conclusion, buyers (contracting organs or economic operators) by providing minimum 5 (five) confirmation for made deliveries issued by the recipients, or if such confirmations can’t be provided due to reasons out of the economic operator control, only its statement for the realized deliveries.

        In order to qualify as capable for performing the subject public procurement contract for Part 2: 1. Experience in successfully realized contracts related to the subject procurement in the last three years (2020,2021 and 2022). The economic operator shall prove the meeting of those minimal conditions for Part 2 of the procedure (Procurement of petroleum and diesel fuel) by submission of the following: 1. List of successfully realized contracts related to the public procurement contracts in the last three years (2020,2021 and 2022), with contract values, dates of conclusion, buyers (contracting organs or economic operators) by providing minimum 5 (five) confirmation for made deliveries issued by the recipients, or if such confirmations can’t be provided due to reasons out of the economic operator control, only its statement for the realized deliveries.

        In order to qualify capable for performing the subject public procurement contract for Part 1:

        1. The economic operator should have at disposal minimum 4 (four) tanks for transport of fuel equipped with installed built-in verified flow meter that is calibrated and have a minutes from the Bureau of Metrology or other legal entity authorized by the Ministry of Economy for performing such an activity. The verified meter should correspond to the register plate of the tank and be installed in the vehicle – the tank. In case all bidders submit evidence that tanks have mobile meters, the bids shall not be reviewed and shall be rejected as unacceptable.

        2. ADR certificate for tanks listed for transport of liquid fuel, the economic operator shall prove the meeting of the subject minimum conditions for Part 1 of the procedure (Procurement of burning oil – Extra light 1 (EL-1) by submitting the following: 1. Statement that the economic operator has at disposal minimum four (4) tanks for transport of fuels equipped with electronic flow meter, which are calibrated and have a minutes from the Bureau of Metrology or other legal entity authorized by the Ministry of Economy for performing such an activity with enclosed evidence. 2. Evidence ADR certificate for tanks listed for transport of liquid fuel. In order to qualify capable for performing the subject public procurement contract for Part 2 (Procurement of petroleum and diesel fuel) from the aspect of its technical and professional capacity, the economic operator shall meet the following minimum conditions:1. Technical capacity for using a non-cash payment system and 2. Having at disposal or providing minimum three gas stations on the territory of the city of Skopje. The economic operator shall prove the meeting of the subject minimum conditions for Part 2 (Procurement of petroleum and diesel fuel) by submitting the following: 1. Statement for using a non-cash payment system, 2. Statement for having at disposal or providing a minimum of three gas stations on the territory of the city of Skopje.

        Minimum level(s) of standards possibly required:

        Quality system standards: In order to qualify as capable for performing the subject public procurement contract from the aspect of quality system standards, the economic operator shall possess QMS – Certificate for quality management system ISO 9001:2015 or equivalent. The economic operator shall prove the meeting of the standards by submitting a valid QMS Certificate ISO: 9001:2015 or equivalent, issued by a certified body.

        -Environment management standards: In order to qualify as capable for performing the subject public procurement contract from the aspect of environment management standards, the economic operator shall possess ISO 14001:2015 Certificate – Environment management standard or equivalent. The economic operator shall prove the meeting of the standards by submitting a valid ISO 14001:2015 Certificate - Environment management standard or equivalent.
