Precise information on deadline(s) for review procedures:

Statthafter Rechtsbehelf bei Verstößen gegen die Vergabevorschriften ist der Antrag auf Einleitung eines Nachprüfungsverfahrens. Der Antrag ist schriftlich bei der zuvor benannten zuständigen Stelle für Nachprüfungsverfahren einzureichen. Der Antrag ist nur zulässig, solange kein wirksamer Zuschlag erteilt worden ist. Ein wirksamer Zuschlag kann erst erteilt werden, nachdem der Auftraggeber die unterlegenen Bieter über den beabsichtigten Zuschlag ordnungsgemäß nach § 134 GWB informiert hat und 15 Kalendertage bzw. bei Versendung der Information per Fax oder auf elektronischem Weg 10 Kalendertage vergangen sind.

Der Antrag ist auch vor wirksamer Zuschlagserteilung unzulässig, soweit:

- der Antragsteller den geltend gemachten Verstoß gegen Vergabevorschriften vor Einreichen des Nachprüfungsantrages erkannt und gegenüber dem Auftraggeber nicht innerhalb einer Frist von 10 Kalendertagen gerügt hat; der Ablauf der Frist nach § 134 Absatz 2 GWB bleibt unberührt,

- Verstöße gegen Vergabevorschriften, die aufgrund der Bekanntmachung erkennbar sind, nicht spätestens bis zum Ablauf der in der Bekanntmachung benannten Frist zur Bewerbung oder zur Angebotsabgabe gegenüber dem Auftraggeber gerügt werden,

- Verstöße gegen Vergabevorschriften, die erst in den Vergabeunterlagen erkennbar sind, nicht spätestens bis zum Ablauf der Frist zur Bewerbung oder zur Angebotsabgabe gegenüber dem Auftraggeber gerügt werden,

- mehr als 15 Kalendertage nach Eingang der Mitteilung des Auftraggebers, einer Rüge nicht abhelfen zu wollen, vergangen sind.
