Nature and extent of the modifications (with indication of possible earlier changes to the contract):

1. Änderung = Flächenerweiterung in Liegenschaft W3 - (ab Vertragsbeginn 01.10.2019)

2. Änderung = Reinigung in der Liegenschaft Rüsselsheim wird aus dem Vertrag genommen; die Reiniegung der Liegenschaft W7 kommt zum Vertrag hinzu (ab 01.03.2020)

3. Änderung (hier in Rede stehend) = Reinigung in der Liegenschaft W6 wird aus dem Vertrag genommen (ab 01.03.2024)

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Die Auftragsänderung war zum Zeitpunkt der Zuschlagserteilung nicht absehbar. So haben sich Arbeitsmodelle in den letzten Jahren nach der Corona Pandemie 2020/2021 stark verändert und ein vermehrtes Arbeiten im Home-Office erzeugt. So führte bei dem hiesigen Bedarfsträger ein verstärktes Arbeiten seiner Mitarbeitenden im Home-Office zur Einführung von desk-sharing und damit verbunden zu einer Reduzierung der Arbeitsplätze und -flächen. Aus diesem Grund sind die Räumlichkeiten in der Liegenschaft W6 ab 01.03.2024 ungenutzt und die Liegenschaft wird vom Bedarfsträger abgemietet. Demzufolge war die Auftragsänderung für den Auftraggeber im Rahmen seiner Sorgfaltspflicht i.S.d. § 132 Abs. 2 S. 1 Nr. 3 GWB auch nicht vorhersehbar.
