Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Innerhalb der Abnahme von 50 Hz - Teilleistungen wurde seitens des Abnahmeprüfers die Begehbarkeit und Arbeitsfläche sowohl

vor einem Betonschalthaus wie auch einem der Verteilerkästen bemängelt. Dieser Umstand wurde in der Ausführungsplanung

vernachlässigt und nicht aufgeführt. Um den Arbeitsbereich zu sichern, wird der Bereich aller im Projekt zu errichtenden

Betonschalthäuser sowie Verteilerkästen durch den ausführenden Auftragnehmer-Bau plattiert.

Ein Wechsel des AN ist aus wirtschaftlichen Gründen nicht möglich, da erhebliche Verzögerungen im Leistungsablauf beizeitlichen Zwängen entstehen würden. Die angebotenen Leistungen sind Voraussetzungen zur Nutzung und Einhaltung derzeitlichen Zwänge bzw. Sperrpausen, die mühsam freigegeben wurden und nur für in einem bestimmten Zeitfenster vorhandensind.
