Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Grundlage für den Anspruch auf Erstattung coronabedingter Mehrkosten ist der Erlass des Bundesministeriums des Inneren vom 17.06.2020 (siehe Punkt 7.1/ Seiten 7-1 bis 7-5) mit einer abschließenden Auflistung der Einzelpositionen. Wie im zweiten Abschnitt im Punkt Ides Erlasses angegeben, werden angesichts des der VOB/B zugrunde liegenden Kooperationsgedankens zur Wahrung eines angemessenen Interessenausgleichs, die zur Eindämmung der Corona-Pandemie durchzuführenden Maßnahmen zur Sicherstellung eines ungestörten Bauablaufs angesehen und damit kostenmäßig als Maßnahme im Sinne von § 4 Abs. 1 Nr. 1 VOB/B. Der Erlass wurde durch das BMVI (Abteilung Eisenbahnen) für den Bereich der Eisenbahninfrastruktur in Bezug genommen und es ist hierzu eine Interne Arbeitshilfe des AG mit Stand vom 03.07.2020 erstellt worden (siehe Punkt 7.2/ Seiten 7-6 bis 7-8), die denErlass weder modifiziert noch einschränkt. Es ergeben sich daher coronabedingte Mehrkosten
