Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Das vorliegende Nachtragsangebot NT 3 umfasst zusätzliche Aufwendungen in der Bauüberwachung für konstruktive

Vorabmaßnahmen für die Erstellung der Bauwerke SÜ Wirtschaftsweg Bleichstraße sowie SÜ A66.

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Im Zuge des Vergabeverfahrens für Bauleistungen zum konstruktiven Ingenieurbau der SÜ A66 (21FEI49777) wurden die

relevanten Baufristen gemäß § 5.1.2 „Beginn auf der Baustelle“ mit 06.09.2021 sowie gemäß § 5.1.6 „Fertigstellung“ mit

01.04.2024 festgesetzt – und entsprechend mit dem BauAN, ARGE SÜ A66 vertraglich vereinbart

Nachtragsangebot NT3:

Der derzeitige Bauablaufplan für den Ersatzneubau der SÜ A66 sieht ein Bauende zum 31.07.2024 vor. Für den Zeitraum von

06/2023 bis 07/2024 wird von Seiten der INGE KVA für zu überwachende Bauumfänge die ursprüngliche Anlage 32

fortgeschrieben bzw. erweitert.
