Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Die Leistung ist zur Erfüllung des vereinbarten Vertragszieles zwingend erforderlich. Die ursprünglich angedachte Vorgehensweise, ein neues Stellwerksgebäude durch die Fa. Thales erbauen zu lassen, konnte aufgrund von beengten Platzverhältnissen im Bereich des Bf. Gerolstein nicht umgesetzt werden. Die Alternativlösung, das Bestandsgebäude in Gerolstein zu sanieren war zwingend erforderlich. Die im Projekt vorherrschende zeitkritische Terminschiene durfte keinesfalls gefährdet werden. Das Stellwerksgebäude ist Grundvoraussetzung um die IBN zu gewährleisten. Die notwendigen Arbeitspakete wie das Planen der Sanierungsleistungen, das Binden und Koordinieren von Handwerkern aus den Gewerken Elektrik, Trockenbau und HLS würde die Terminschiene um ca. 2 Monate verschieben. Mit jedem Tag Verzögerung verschiebt sich die Inbetriebnahme um den gleichen Zeitraum. Mit jedem Tag verspäteter Inbetriebnahme verliert die Bahn Einnahmen die durch Verfügbarkeit der Strecke generiert werden könnten. Des Weiteren ist die Verfügbarkeit der Bahnstrecke für Schüler und Pendler besonders wichtig. Die Fa. Weidlich konnte die Leistungen in der vorgegebenen Zeitschiene garantieren und aufgrund der bereits vorhandenen Ortskenntnis die gesamte Koordination übernehmen. Zudem sind Teile der Leistung bedingt durch die vertraglich geschuldete KTB Leistung im Gebäude bereits bei der Fa Weidlich. Die Arbeit konnte nicht durch die Fa. Thales und auch nicht durch ein drittes Unternehmen geleistet werden.
