VII.2.1)Description of the modifications

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

LÄA 02 LOS 6 Der AN ist mit der Umsetzung der vorgezogenen Umweltmaßnahmen im PfA 8.1 im StA 8A mit dem Los 6 beauftragt. Eine dieser Maßnahmen ist die MArt 19 (CEF) - Anbringen von Nistkästen und die MArt 55 (CEF) - Installation von Fledermauskästen und Einrichtung einer Pufferzone mit Höhlenbaumsicherung (Fledermäuse). Bei der Umsetzung der Maßnahmen MArt 19 (CEF) und MArt 55 (CEF) werden die Nistkästen bzw. Ersatzquartiere in Abstimmung mit der UBÜ und dem Revierförster angebracht. Der Hauptvertrag sieht die Lieferung und das Anbringen der Kästen vor. Für die Auswahl der geeigneten Bäume für die Nisthilfen bzw. Ersatzquartiere ist qualifiziertes Personal mit ornithologischen und auf Fledermäuse spezialisierten Fachkenntnisse erforderlich. Gegenstand der vorliegenden LÄA 02 des Los 6 im PfA 8.1 ist die zusätzliche Leistung zur Bestimmung geeigneter Bäume zur Anbringung der Nistkästen und Quartiere durch qualifiziertes Personal

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Zur erfolgreichen Umsetzung der Maßnahmen MArt 19 (CEF) und MArt 55 (CEF) ist die Einbeziehung eines qualifizierten Personals zur Auswahl der geeigneten Bäume und zur Einhaltung der Kriterien technisch notwendig und unausweichlich. Der AN verfügt über die notwendige Infrastruktur, insbesondere den benötigten Fachexperten, zur Leistungserbringung, ein anderer AN müsste sich Grundlagen und vertiefte Kenntnisse der Leistung erst erarbeiten. Dies würde sich negativ auf Qualität der Leistung, die Kosten und den Projektterminplan auswirken.

Die Einarbeitung eines neuen AN ohne Projektkenntnis in dieses komplexe und umfangreiche Themenfeld ist mit erheblichen Schwierigkeiten und zudem mit einem hohen Risiko eines Informationsverlustes verbunden und daher abzulehnen. Es würde im laufenden Prozess zu einem unnötigen Verzug führen, Kosten für das Projekt verursachen und entspricht somit nicht dem vorgegebenen wirtschaftlichen Handeln.
