Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. VII.2.1)Description of the modifications

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Hintergrund: Aufgrund der positven Nutzen-Kosten-Bewertung des Deutschlandtaktes (D-Takt) durch das

BMDV (alt BMVI) wird der D-Takt als wirschafltich angesehen. Somit ist in Abstimmung mit EBA und BMDV

der D-Takt im Projekt umzusetzen. Aus diesem Grund ergibt sich eine Zielfahrzeit für das übergreifende

Vorhaben Ostkorridor Süd (OKS). Die daraus resultierende Geschwindigkeitserhöhung war zum Zeitpunkt

der Beauftragung noch nicht bekannt.

Beschreibung der Vertragsänderung: Da die Geschwindigkeitserhöhung / der Fahrzeitgewinn auf der

Bestandsstrecke aufgrund der Topographie nicht erreicht werden kann, sind weitere trassierungstechnische

Maßnahmen im Rahmen einer Trassierungsstudie zu untersuchen. Diese Trassierungsstudie muss dabei

verschiedene Varianten zur Anhebung der Geschwindigkeit unteruschen und diese dabei Nutzen- und

Kostenmäßig bewerten. Als Wertungsfaktoren sind dabei Fahrzeitberechnungen, Kostenschätzungen und

Variantenbetrachtungen über alle Gewerke hinweg zu unterstellen. LÄ01

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Begründung der Vertragsabweichung:

Hintergrund: Durch das Aufsteigen des Deutschlandtaks (D-Takt) in den vordringlichen Bedarf des BVWP

2030 wurde die Umsetzung dessen als wirtschaftlich eingeordent. Im Rahmen des Vorhabens Ostkorridor

Süd, insb. des Projekts Elektrifizierung Marktredwitz-Regensburg (EMR) haben sich hierdurch wesentliche

Planungsprämissen und -parameter geändert. So ist im Fernverkehr eine Zielfahrzeit zwischen

verschiedenen Knotenbahnhöfen im D-Takt vorgesehen.

Begründung: Da die Zielfahrzeiten in Abstimmung mit EBA und BMDV zwingend im Projekt EMR

umzusetzen sind, sind verschiedene Varianten zur Fahrzeitverkürzung / Geschwindigkeitserhöhung zu

untersuchen. Um die Varianten untersuchen zu können, ist hierfür eine Trassierungsstudie notwendig. Diese deutlichen

Trassierungsänderung sind zur Zielerreichung des Gesamtprojektes zwingend notwendig. Diese weiterführenden Trassierung sind im Hauptvertrag nicht aufgeführt und stellen somit eine

zusätzliche Leistund dar.
