Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Der Auftragnehmer ist mit der Baumaßnahme bzgl. der Signalausleger beauftragt. Hierfür ist zwingend eine Ausführungsplanung erforderlich. Folglich ist diese Leistung zu Erfüllung des ursprünglichen Vertrags erforderlich. Der Auftragnehmer ist mit der Baumaßnahme bzgl. der Signalausleger beauftragt. Aus den vorliegenden Finanzierungsbedingungen und in Hinblick auf die Minimierung von möglichen Nachtragspotenziale, ist es geboten die dazugehörige Ausführungsplanung ebenfalls durch den Bauauftragnehmer, der die Maßnahme realisiert, erbringen zu lassen. Bei anderweitiger Vergabe der Leistung besteht aus den Vorgaben vom EBA das hohe Risiko, dass jede Anpassung der Planung im Risiko des Auftraggebers zu verorten ist. Dies bedeutet, dass diese angepasste Leistung nicht mehr förderfähig ist. Um dieses realistische Risiko zu begegnen, ist eine gemeinsame Vergab von Ausführungsplanung und Bauleistung zwingend erforderlich.
