Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Aufgrund unzureichrender und mangelbehafteter Dokumentationen von Veränderungen der Bestandsanlage, sowie die nicht

ausreichende Rund-Um-Betrachtung der beauftragten Objekte aus der vorherigen Planungsphase, hat der Auftragnehmer

Mehrbedarfe, also weitere Planugnsstunden, hinsichtlich nicht beauftragten, neuen Objekte erkannt und angezeigt.

Gleichfalls sind auch Mehraufwände, im Sinne von weiteren Planungsstunden, auch bei bereits beauftragten Objekten identifiziert

worden.

Need for additional works, services or supplies by the original contractor/concessionaire (Art. 43(1)(b) of Directive 2014/23/EU, Art. 72(1)(b) of Directive 2014/24/EU, Art. 89(1)(b) of Directive 2014/25/EU)
Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Aufgrund dessen, dass weiterhin die gleichen Anlagen beplant werden sollen, bzw. nur weitere einzelne Anlagenteile von der

bereits beauftragten Anlagen neu zu beplanen sind, wäre eine weitere Vergabe an einen neuen Auftragnehmer wegen der hohen

technischen Verzahnung mit einer Doppelbeauftragung gleichzusetzen. Denn der neue Auftragnehmer müsste sich mit dem

bereits gebundenen Auftragnehmer wegen notwendigen Abstimmungen zu Schnittstellen intensiv austauschen, wodurch der

bereits gebundene Auftragnehmer in gewisser Weise sowieso die Leistungen erbringt. Dies ist mit einer Doppelbeauftragung

gemeint.
