Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Aufgrund des fehlenden Gleises bzw. Gleisanschlusses für das fernbahnlinke Gleis können die Oberleitungsarbeiten (z.B Kettenwerkszug) nicht wie geplant ausgeführt werden. Durch die verzögerte Bereitstellung des Gleises, fehlt die benötigte Zeit für die Durchführung der Oberleitungsarbeiten. Um die Inbetriebnahme am 16.08.2021 einhalten zu können, muss für die Realisierung der Oberleitungsarbeiten mehr Personal und Geräte zur Verfügung gestellt werden.
