VII.2.1)Description of the modifications
Nature and extent of the modifications (with indication of possible earlier changes to the contract):

MKA07: Aufgrund Änderungswünsche der ALV werden die SHP im km Bereich 12,5 bis 12,7 umgebaut. Hierzu werden die obersten Platten mit H = 250mm ausgebaut, die Pfosten um das entfallende Maß nach unten gerammt. Dies erfolgt an 22 bis 23 Feldern. Die dann überzähligen Platten werden in ca. 13 neu herzustellenden Feldern eingebaut in Richtung Rimbach.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Der Wechsel des Auftragnehmers brächte erhebliche Verzögerungen im Leistungsablauf und der Inbetriebnahme mit sich. Synergieeffekte durch eine einheitliche Leistungsdurchführung und -betreuung würden verloren gehen und es könnte zu gegenseitigen Behinderungen kommen. Ebenfalls wäre nicht mehr hinreichend erkennbar bei welchem Arbeitnehmer man ggf. Mängelansprüche geltend machen muss. Manche Positionen könnten auch aus technischen Gründen nicht an einen weiteren AN

weitergegeben werden, da diese Leistungen mit Leistungen aus dem Haupt-LV ineinandergreifen. Die zeitliche Verzögerung, welche mit dem Wechsel des ANs einherginge, hätte enormen Einfluss auf den geplanten Bauablauf und der damit einhergehenden Inbetriebnahme, was zu erheblichen Schwierigkeiten und Zusatzkosten führen würde.
