Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Der ursprüngliche Vertrag beinhaltet die Genehmigungsplanung und die Entwurfsplanung der KIB für den PFA 3.2a. Der PFA

3.2a wurde um den Bereich der Kurve Wedau erweitert und deshalb werden folgende zusätliche Leistungen. Aus der neuen

Trassierung der Strecken 2326 und 2320 un der Statiknachrechnung der zwei vorhandenen Bauwerke EÜ Kruppstraße und EÜ

Zufahrtsweg im Bereich der im PFA 3.2a integrierten Kurve Wedau hat es sich ergeben, dass die zwei Bauwerke nicht tragfähig

sind. Folge daraus ist, dass die zwei Bauwerke für einen Ersatz- Neubau geplant werden müssen.
