- Erstellung/Überarbeitung einer projektspezifischen Statik für das Kunststoff-Bewehrte-Erde-System,

- Erstellung/Überarbeitung von Werkszeichnungen für die Bauausführung der KBE unter Berücksichtigung der geänderten Materialverfügbarkeit und -qualität,

- Erstellung/Überarbeitung von Absteckungsunterlagen.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Mit der weiteren Überarbeitung der Statik für die KBE im Bereich der Südböschung und die zugehörigen Werkszeichnungen kommt es zu einer Änderung des Bauentwurfs gemäß § 2 Abs. 5 VOB/B und damit zu einer Änderung der Grundlagen des vertraglich vereinbarten Preises. Die Änderung beinhaltet zusätzliche Leistungen aufgrund der weiteren Konkretisierung und der hierauf aufbauenden Statik sowie Ausführungsvorhaben. Die Ausführung stellt eine im Vertrag nicht vorhergesehene Leistung dar und damit ist ein Anspruch auf besondere Vergütung als auch Kostenminderungen abzuleiten.Ein Auftragnehmerwechsel ist nicht wirtschaftlich, da dies zu zeitlichen und räumlichen Behinderungen mit evtl. entsprechenden Zusatzkosten geführt hätte. Des Weiteren hätte eine Verzögerung das Erreichen des Sanierungsziels gefährden können.
