Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Am Tarifpunkt Oberhausen muss der Bahnübergang an der Baustelleneinrichtungsfläche erneuert werden.Der Bahnübergang befindet mittlerweile desolaten Zustand und gefährdet die Weiterführung der Gleislogisitk, so dass die Gefahr besteht, dass die Gleislogistik nicht mehr durchgeführt werden kann. Das hätte zur Folge, dass erforderliche Transporte in Richtung Baustelle (Duisburg Vst) nicht mehr möglich wären.Diese Leistungen erfordern entsprechend die Begleitung einer Fachbauüberwachung.Zu bgeleitende Arbeiten sind:

Herstellen des provisorischen Bahnübergangs zur Aufrechterhaltung der LKW Logistik,Vermessung / Absteckung der Gleise, Verlegen der Längserde im Bau, Umbau der drei Gleise inkl. Bahnübergang mit Schotter / PSS KG1 / Geotextil ,Einbau des Systems Bodan in den Gleisbereichen,Herstellung der prov. Asphaltfläche vor Kopf und zwischen den Gleisen bis zur endgültigen Fertigstellung in der Sperrpause Dezember 2023,Rückbau des provisorischen Bahnübergangs,Rückbau der Länserde.
