Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

VII.2.1)Description of the modifications
Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Für die Inbetriebnahme des ESTW-A Neukieritzsch waren zusätzlichen Anpassungen an schon baufreigegebenen PT1- Planungen erforderlich. Die Anpassungen der Planungen hatten mehrere Ursachen. Dieses waren insbesondere das Verbot der Blockverbindung MCL84 – RBII BSA (LNK – LDTZ) seitens des EBA sowie der Umbau des BÜ 22,3 in eine Halbschrankenanlage aufgrund der Abkündigung der geplanten GFR-Anlage der Fa. Honeywell.

Weitere Anpassungen ergaben sich aus der PT2 Projektierung, die teilweise eine Anpassung der baufreigegebenen PT1 Planungen zur Folge hatte.

Des Weiteren wurden zusätzlich Bestandspläne für jeden Bauzustand erstellt und an IZ-Plan zurückgeführt.

Diese zusätzlichen PT1- Planungen konnten nur durch die INGE GRE – SSF ausgeführt werden, da sich alle Planungsgrundlagen bei der Ingenieurgemeinschaft befinden und ein Herauslösen in separate Planungspaket aufgrund der Planungsabläufe nicht möglich ist

Ein Wechsel des AN ist nicht möglich, da sich alle Planungsgrundlagen bei der Ingenieurgemeinschaft befinden und ein Herauslösen in separate Planungspaket aufgrund der Planungsabläufe nicht möglich ist.
