Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Need for additional works, services or supplies by the original contractor/concessionaire (Art. 43(1)(b) of Directive 2014/23/EU, Art. 72(1)(b) of Directive 2014/24/EU, Art. 89(1)(b) of Directive 2014/25/EU)

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Aufgrund eines erhöhten Leistungsbedarfes der Stromversorgung in den ESTW Modulgebäuden Langenselbold und Wirtheim muss ein neuer Trafo mit höherer Leistung im ESTW Langenselbold eingebaut und der Trafo in Langenselbold muss ausgebaut und in Wirtheim eingebaut werden. Der Trafo mit zu geringer Leistung in Wirtheim muss ausgebaut werden. Die Erstellung der Stromversorgungsanlage (Netzersatzversorgung mittels Transformator) erfolgte bereits hauptvertraglich geschuldete Leistung des AN. Die Änderung der Trafoleistung ist zudem notwendig um den geschuldeten Werkerfolg zu liefern. Die Einbindung eines weiteren AN zur Durchführung des Trafotausches hätte eine weitere Gewährleistungsschnittstelle erzeugt. Im Gewährleistungsfall wäre es nicht möglich die Ansprüche klar zuzuordnen.
