Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Es handelt sich hierbei um eine Leistung aus dem HV, welche zeitlich verschoben wurde. Eine erneute Ausschreibung der Leistungen wäre daher wirtschaftlich und aus vertraglicher Sicht nicht vertretbar gewesen. Der durch den Ausfall der Sperrpause entstandenen Aufwand im Vorfeld inkl. Disposotion kann nicht ausgeschrieben werden.
