Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

5 - Herstellung der zwei Grundwassermessstellen (GWM) 2S-6/48 und 2S-6/49 als Ersatz für die beiden GWM U5 158 und NS 70.

Die beiden GWM sind in Abhängigkeit zur angetroffenen Geologie ca. 60 m tief auszuführen und sollen in Abhängigkeit zur angetroffenen Geologie jeweils in den Aquiferen TII, TIII und TIV ausgebaut werden. Der Bohrenddurchmesser beträgt 368 mm, der Ausbaudurchmesser beträgt pro Aquifer DN65.

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

5 - Herstellung der zwei Grundwassermessstellen (GWM) 2S-6/48 und 2S-6/49 als Ersatz für die beiden GWM U5 158 und NS 70.

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Erst im Zuge der detaillierten Planung bestand Klarheit über die betroffenen Aquifere und deren Mächtigkeit bzw. über die Mengen, die pro Aquifer zu erwarten sind. Die Aquifere müssen während der gesamten Bauzeit mittels GWM beobachtet werden. Teilweise werden dazu bestehende GWM von dritten eingesetzt.

Im Zuge der Zustandsfeststellung der entsprechenden GWM für das großflächige Grundwassermonitoring im Bereich Marienhof wurde festgestellt, dass die 2 bestehenden GWM U5 158 und NS 701 (wurden der DB vom WWA übergeben) nicht funktionsfähig sind.

Um der Forderung des Wasserwirtschafsamtes (WWA) nach einem großflächigem GW-Monitoring nachkommen zu können, müssen durch die DB zwei Ersatz-GWM hergestellt werden.

Für den AG war trotz umfangreicher Voruntersuchungen und sorgfältiger Planung nicht vorhersehbar, dass sich die von Dritten übergebenen GWM nicht funktionstüchtig sind.
