Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Im Rahmen der bisherigen Abstimmungen wurde festgestellt, dass Leistungen der VP für den SÜ km 64,866 erbracht werden müssen. Dies begründet sich damit, dass zusätzliche Abweichungen von der VP identifiziert worden sind: Der Berührschutz der bestehenden Brücke ist aufgrund des notwendigen Abstands der Ränder zu den Gleisachsen zu überprüfen, so dass eine ergänzende Objekt- und Tragwerksplanung für die Berührschutztplatten erforderlich ist. Solche Abweichungen führen im Rahmen

der weiteren Planung zu einer geänderten Lösungsvariante. Aufgrund des o.g. Sachverhalts ergibt sich ein Mehraufwand in Form von Zusatzleistungen der Leistungsphase 1 und 2. Die Erbringung solcher zusätzlichen Leistungen dient somit zur Erfüllung des ursprünglichen Vertrages.

Bei Beauftragung eines anderen AN gehen Synergieeffekte verloren, da die Planungsgrundlagen, die Randbedingungen und die Örtlichkeit unbekannt sind.
