VII.2.1)Description of the modifications

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

MKA34: Um eine wasserdichte Verbindung zwischen den verschiedenen Bauelementen der PU herzustellen, müssen wasserdichte Fugen geschaffen werden. Gemäß den Vorschriften der RRIL DB sowie den Zusätzlichen Technischen Vertragsbedingungen und Richtlinien für Ingenieurbauten (ZTV-Ing.) müssen Bauwerksfugen entsprechend den freigegebenen Ausführungsplänen hergestellt werden. Die zu erbringende Leistung entspricht nicht den freigegebenen Ausführungsplänen. Aus diesen Ausführungsplänen geht ein zusätzlicher Mengenbedarf hervor.

Need for additional works, services or supplies by the original contractor/concessionaire (Art. 43(1)(b) of Directive 2014/23/EU, Art. 72(1)(b) of Directive 2014/24/EU, Art. 89(1)(b) of Directive 2014/25/EU)

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Es ist erforderlich, dass die Bauwerksfugen gemäß den Vorschriften der RRIL DB und ZTV-Ing. sowie den entsprechenden freigegebenen Ausführungsplänen hergestellt werden. Die Leistungen werden vom Bauunternehmer gemäß den freigegebenen Ausführungsplänen erbracht. Es besteht jedoch eine Abweichung zwischen der vertraglich vereinbarten Leistungsmenge und der

erforderlichen Menge. Der Gesamtcharakter des Auftrags bleibt hierbei unverändert. Die zusätzlichen Leistungen sind zur Sicherstellung des Projekterfolges zwingend notwendig und stehen in unmittelbarem Zusammenhang zum Leistungssoll des ursprünglichen Vertrages.
