Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

2. Entfernung der SSW-Außenwände aus den bisherigen Plänen

3. Aufnahme von BüG (Besonders überwachtes Gleis) in die bisherigen EP-Unterlagen

4. Fortschreibung der Kostenpläne gemäß den o.g. Änderungen.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Die Begründung für die o.g. zusätzlichen Leistungen wird nachfolgend erläutert:

1. Der noch zu realisierende Abschnitt der SSW muss aus baubetrieblichen Gründen und mangelnden Platzverhältnissen vom Gleis aus erfolgen. Die bisherige EP hat die Gründung der SSW gemäß ursprüng-lichem Bodengutachten mit Bohrpfählen vorgesehen. Vom Gleis aus ist die Realisierung dieses Verfahrens jedoch technisch nicht möglich. Entsprechend dem neuen Bodengutachten von Oktober 2021 kann die Gründung auch über Rammrohre erfolgen, deren Herstellung über das Gleis erfolgen kann. Entsprechend ist es erforderlich umzuplanen.

2+3: Zur Sicherstellung der dispositiven Möglichkeit der Überleitung von Zügen von/zur Rtb über die NBS durch den/vom Katzenbergtunnel wird eine eingleisige Überleitverbindung (von km 242,5+50 bis km 243,2+00) nördlich des Katzenbergtunnels vorgesehen. Dies hat zur Folge, dass eine ursprünglich als durchgängige Schallschutz-Mittelwand vorgesehene Schallschutzmaßnahme auf einer Länge von ca. 180 m (km 242,7+50 bis km 242,9+31), unterbrochen wird. Zur Kompensation der hierdurch verursachten Pegelzunahmen ist nun zum Schallschutz ein Besonders Überwachtes Gleis (BÜG) vorgesehen. Dieses erreicht gemäß aktuellem Schallgutachten gegenüber der ursprünglich vorgesehenen SSW eine bessere Schallreduktion und ist kostengünstiger in der Realisierung. Aus dieser Planänderung resultiert, dass die Planunterlagen entsprechend angepasst werden müssen.

4. Gemäß den o.g. Änderungen ist es erforderlich, den Kostenplan entsprechend anzupassen.
