Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Vertraglich sind Bauüberwachungs-Leistungen vorgesehen, für den Bauvertrag der Festen Fahrbahn. Die im NA genanntenzusätzlichen Leistungen sind erforderlich um alle im Bauvertrag vorgesehenen untergeordneten Gewerke richtlinienkonform undbauaufsichtlich korrekt zu überwachen.Bei einem zweiten bauüberwachenden AN würden zahlreiche Leistungen der BÜ doppeltausgeführt werden. Von der BÜ zu erstellende Dokumentationen müssten doppelt erstellt und strukturiert werden. DieEinarbeitung und Organisation in einen umfangreichen Auftrag würde doppelt anfallen, genauso wie die Nachverfolgung derzugehörigen Bau- und Planungsleistungen. Im Gegensatz dazu werden bei nur einem bauüberwachenden AN auchSynergieeffekte beim örtlichen Personal genutzt.Bei mangelhafter Leistung der Bauüberwachung wäre eine klare Zuordnung derVerantwortlichkeiten bei zwei bauüberwachenden AN für einen Bauvertrag nicht möglich.
