Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Nach der Begehung mit dem Inbetriebnahmeverantwortlichen müssen noch zusätzliche Stahlbauarbeiten erfolgen. Darunter

fallen die Herstellung zusätzlicher Dienstweggeländer an der Dienstwegtreppe, Anpassungsarbeiten an den Seitenblechen

der Rampe am Kasselburger Weg, Riffelblechkonstruktionen, Lückenschluss der Seitenbleche am Übergang der Rampe/PÜ

und zusätzliche Lieferung und Montage Lochblech am Aufzug. Der Wechsel des Auftragnehmers ist nicht möglich, da die

Schnittstellenplanungen der Stahlbauarbeiten die Gefahr der Fehlplanung massiv erhöht.
