Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. VII.2.1)Description of the modifications
Nature and extent of the modifications (with indication of possible earlier changes to the contract):
MKA136: Rückbau provisorischer Gleisquerungen
Im Baustellenbereich des ESTW-ZU Gelnhausen wurden auf Grundlage der freigegebenen AP provisorische Querungen mittels DN110er Kunststoffrohren gebaut um einen temporären LST-Bauzustand zu ermöglichen. Als Baufeldfreimachung für den folgenden Bauzustand müssen dieses Querungen entfernt werden, damit Querungen in offener Bauweise gebaut werden können. Die Notwendigkeit der temporären Querungen ergab sich aus der AP, sodass der entsprechende Bedarf zum Zeitpunkt der Ausschreibung noch nicht bekannt war.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:
Der AN schuldet die Herstellung der notwendigen Kabeltrassen inkl. Querungen, sowohl für den Endzustand, als auch für Zwischenzustände. Zudem beruht die Bauausführung auf der vom AN erstellten AP, sodass hier auch ein zwingender Gewährleistungszusammenhang vorliegt. Eine Einbindung eines zusätzlichen AN für den Rückbau der provisorischen Querungen würde zu einer zusätzlichen Gewährleistungsschnittstelle führen. Eventuelle Gewährleistungsfälle könnten dem bisher beteiligten AN somit nicht klar zu gewiesen werden. Eine Einbindung eines zusätzlichen AN würde einen deutlichen Koordinationsmehraufwand bedeuten. Da für die beschriebenen Maßnahmen Sperrpausen benötigt werden, besteht die Gefahr, dass diese lange im Voraus beantragten Sperrzeiten zur Umsetzung der Leistung nicht ausreichen. Projektverschiebungen wären hierdurch nicht auszuschließen.
