La consultation est un appel d’offres ouvert passé en application de l’article R2124-2 1° du code de la commande publique.

Compte tenu du volume incertain des commandes réalisées, chaque lot est un accord-cadre à bons de commande conformément aux dispositions de l’article R2162-4 1° et R2162-4 2° du code de la commande publique. Les seuils des commandes à intervenir sont les suivants :

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

En cours d’exécution du marché, le titulaire doit faire face à des conditions économiques nouvelles nées de la crise sanitaire et du conflit russo-ukrainien. Plus précisément, ce dernier subit une hausse du prix des matières premières et une hausse du coût de l’énergie.

Il doit également faire face à des difficultés d’approvisionnement pour certaines matières premières et à une envolée de leurs coûts de fabrication et de distribution.

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

En application des recommandations de la circulaire n°6374/SG du 29 septembre 2022 relative à l’exécution des contrats de la commande publique dans le contexte actuel de hausse des prix de certaines matières premières et conformément à l’article R.2194-5 du code de la commande publique, il convient de modifier les prix figurant au Bordereau des Prix Unitaires du lot n°2.Les fournitures commandées dans le cadre du lot n°2 font l’objet d’un nouveau Bordereau des Prix Unitaires.La durée d’application des nouveaux prix du B.P.U. est fixée à la date de notification de l’avenant n°1 jusqu’au 30 septembre 2023.
