Ugovor se djelomično raskida, te ostaje na snazi za dio nužnih radova koje je potrebno izvesti zbog sigurnosti i neometanog odvijanja prometa. Radovi na etapama 2, 10 i 11 se izuzimaju iz ugovora i bit će predmetom nove nabave. Vrijednost ugovora nakon izmjene iznosi 32.023.270,58 EUR bez PDV-a.

VII.2.2)Reasons for modification

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Zbog okolnosti na koje Naručitelj nije mogao utjecati, isti nije bio u mogućnosti pribaviti te Izvođaču predati pravomoćne građevinske dozvole za etape 2, 10 i 11. Posljedično, u tom dijelu Izvođač nije u mogućnosti započeti s izvođenjem radova, te se pristupilo sporazumnom djelomičnom raskidu ugovora. Sukladno čl.315. ZJN iz ugovora su izuzeti radovi na etapama 2, 10 i 11 i bit će predmetom novog postupka nabave. Preostali nužni radovi će se izvesti radi sigurnosti i neometanog odvijanja prometa.
